Terms of Service
Who we are
Svare is operated by Arkay Labs Ltd, a company registered in England and Wales.
What Svare does
Svare connects to your email and your Shopify store and drafts replies to customer support messages. Every draft is a suggestion. A human on your team reviews it and approves it before anything is sent. Svare is provided to businesses, not to consumers.
Your account
You are responsible for keeping your account credentials safe and for any activity that happens under your account. You must have the authority to connect the mailbox and the store you connect to Svare.
Acceptable use
You may not use Svare for anything unlawful, put an abusive load on the service, try to breach or probe it, or resell it without our agreement.
Your data
You retain all rights to your data. We process it only to provide the service, in the way described in our Privacy Policy.
Availability and changes
Svare is a pre-launch, beta service provided as is. Features may change as we develop the product. We may suspend an account that breaches these terms.
Liability
To the extent the law allows, our liability is limited to the fees you paid us in the 12 months before a claim. Nothing in these terms excludes liability that cannot be excluded by law, such as liability for fraud.
Governing law
These terms are governed by the law of England and Wales.
Dispute evidence drafting
Where Svare assembles or drafts chargeback or payment dispute evidence, it acts as a drafting assistant. You review and approve every evidence package before it is staged or submitted, and you are responsible for the accuracy and completeness of anything you approve. Approval is recorded with your name, the time and a fingerprint of the exact package. Svare does not guarantee the outcome of any dispute.
Warranty disclaimer
Svare is provided as is and as available, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, secure or error free.
Limitation of liability
To the fullest extent permitted by law, Arkay Labs Ltd is not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill. Our total aggregate liability for all claims arising out of or in connection with the service in any 12 month period is limited to the amounts you paid us for the service in that period. Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
Indemnification
You will indemnify and hold harmless Arkay Labs Ltd against claims, losses, liabilities and reasonable costs arising from content you supply, evidence packages you approve for submission, your breach of these terms, or your breach of applicable law.
Termination
You may cancel and stop using Svare at any time. We may suspend or terminate an account for material breach of these terms, for non payment, or where required by law, giving notice where reasonably possible. On termination your data is handled as described in the Privacy Policy, including the 30 day deletion commitment.
Governing law and disputes
These terms are governed by the laws of England and Wales. Before either side starts formal proceedings, both agree to try in good faith to resolve any disagreement directly within 30 days of written notice. The courts of England and Wales have exclusive jurisdiction.
